Board Of Management

In every notified area there is a committee called "the Board of Management" appointed by the Government. The Board of Management consists of the following members, namely:

  1. The President of the Industries Association of the notified area.
  2. The Honorary Secretary of the Industries Association of the notified area.
  3. Two members, other than the members specified in clause (1) and (2), as may be nominated by the Industries Association of the notified area.
  4. One representative of industries as may be nominated by the Corporation.
  5. One representative from amongst the local residents as may be nominated by the Board of Management.
  6. Two officers not below the rank of Assistant Manager or Deputy Executive Engineer, as may be nominated by the Corporation
  7. One officer not below the rank of Assistant Manager or Deputy Executive Engineer, shall be nominated by the Corporation as the Cheif Officer, who shall be the Secretary of the Board of Management

While nominating representatives of the industries on the Board of Management, adequate care is excersiced that industrial units located within the notified area which utilise the maximum capacity of various infrastrucructure such as water, drainage, etc., are not neglected due to their numerical minority.

Provided that in case of notified area having single unit, the Board of Management does not consist,

  1. more than three members, not below the rank of managerial cadre from the concerned unit.
  2. more than two officers, not below the rank of Assistant Manager or Deputy Executive Engineer, as may be nominated by the Corporation. From amongst the officers so nominated one office is appointed as the Chief Officer, who is the secretary to the Board of Management.

Appointments, Terms and Conditions

Being a Board Member

  1. No member, other than the members nomiated or appointed by the Corporation, is appointed as member of the Board of Management unless he,
    • has an industry in that notified area, or
    • is holding a senior management position in the industry situated in the notified area for a period not less than three years, or
    • is a resident of that notified area,
    • is not a defaulter in the payment of consolidated tax and
    • is not have been sentenced to jail for any criminal offences.
  2. The term of a member of the Board of Management is for a period of two years.

  3. Provided that the members of the Board of Management holds office initially for a period of two years; and half of the members, as may be determined by the Government, who do not hold office by virtue of their position in the Industries Association or the Corpoartion retires after completion of third year.

    Provided further that no person is allowed to remain on the Board of Management continuously for more than three years.

  4. A member is allowed to be re-nomiated after a gap of three years.

Being a Board Chairman

  1. The Board of Management elects one of its members to be its Chairman.
  2. The Chairman of the Board of Management holds office for a period of one year.

Meeting

The Board of Management meets at least once in a month to take decisions on the items placed on the agenda by the Chief Officer and to review the progress of the work done in the notified area. The Board of Management approves the annual budget of the notified area; take decisions about the taxation, levy of charges, if any, in accordance with the provisions of the Act, consolidated tax rules and Gujarat Industrial Development (Notified Area) Rules, 2007. The Board of Management suggests new works to be undertaken and priorities to be given to the various items of work.

No business is transected at any meeting of a Board of Management unless at least five members are present thereat.

Functions

The Board of Management performs its funtions and duties in accordance with the provisions of the Gujarat Municipalities Act, 1963 as extended to and brought into force in the Notified Area under clause (a) of sub-seciton (1) of section 16 and adhers to the direction given by the Government or the Corporation or the Director of Notified Areas from time to time for the purose of maintaining transperancy in the management of the affairs of the notified area, maintaining financial propriety and providing efficient and cost-effective administration in the notified areas.

Notwithstanding anything contaied in sub-rule (1), it is the duty of Board of Management to make reasonable and adequate provision for the following matters within the limits of the notified area, namely:

  1. construction and maintenance of roads, public streets, culverts, municipal boundry marks, markets, slaughterhouses, privies, drains, sewers, drainage works, sewerage works etc.,
  2. construction and maintenance of water works and adequate water supply to the residential, industrial and commercial units as and when this function is transferred by the Corporation to the notified area,
  3. construction and maintenance of storm water drains,
  4. lighting public street lights, places and buildings and their maintenance,
  5. cleansing of publice streets, collection, transportation and disposal of solid waste,
  6. disposing of night soil,
  7. extingushing fires and protecting life and property when fire occurs,
  8. registration of birth and death,
  9. passing of building plans and revising town planning within the limits of the borough as per the law relating to town planning,
  10. acquiring and maintaining places for disposal of dead and disposal of carcasses of dead animals,
  11. construction and maintenance of public laterines and urinals,
  12. removing obstructions and projections in public streets or places,
  13. naming streets and numbering premises,
  14. securing or removing dangerous buildings and reclaiming unhealthy localities,
  15. introducing and maintaining system of water closets,
  16. paying salary etc., for the police or guard required for the protection of municipal properties.

The Board of Management at its discretion takes up some of the fuctions from among those mentioned in section 91 of the Gujarat Municipalities Act, 1963 for the public welfare from its funds without adversely affecting the essential services, by levying additional tax or service charges or any charges, from the surplus funds, if any.
